Member Agreement
This Member Agreement (“Agreement”) is a contract between you (“Member,” “you,” or “your”) and Siouxland Made, operating the website siouxlandmade.com and its “Home” community platform located at siouxlandmade.com/home (collectively, the “Platform”). By creating an account, posting content, or otherwise using the Platform, you agree to be bound by this Agreement. If you do not agree, do not register for or use the Platform.
1. What the Platform Is
The Platform allows Members to create and manage: (a) Event Listings; (b) Business/Maker Directory Listings; (c) Job Board Listings; and (d) posts, comments, and discussions within the Community Forum (collectively, “Listings” and “Content”). Siouxland Made provides the tools and space for Members to publish this information to one another and to the public.
2. Our Role: We Are a Pass-Through, Not a Party to Your Dealings
2.1 Neutral platform. Siouxland Made is a neutral venue and technology provider. We do not organize, host, sponsor, endorse, guarantee, staff, or take part in any event, business transaction, job offer, sale, service, or arrangement that a Member posts, promotes, or agrees to through the Platform. We simply provide the space where Members connect with one another.
2.2 We are not a party to Member agreements. Any commitment, promise, representation, sale, hire, booking, RSVP, or agreement made between Members — including but not limited to attendance at an event, the accuracy of a directory listing, the terms of a job posting, or any statement made in the Community Forum — is solely between the Members involved. Siouxland Made is not a party to, and assumes no responsibility or liability for, the performance, non-performance, accuracy, safety, legality, or outcome of any such arrangement.
2.3 No endorsement or verification. We do not independently verify the identity, credentials, qualifications, insurance, licensing, or trustworthiness of any Member, and we do not guarantee that any Listing is accurate, current, or will be fulfilled as stated. Members are solely responsible for evaluating and dealing with one another, and are encouraged to exercise reasonable judgment and caution.
2.4 No liability for Member conduct. To the fullest extent permitted by law, Siouxland Made disclaims all liability for any loss, damage, injury, dispute, or expense arising from or related to interactions, transactions, or agreements between Members, whether arising from an Event Listing, Directory Listing, Job Board Listing, or Community Forum post.
3. Event Listings
3.1 Posting Events
Members may post events to the Platform’s event calendar, including community meetups, markets, classes, and similar gatherings. When you post an event, you are representing to other Members that the event will occur substantially as described.
3.2 Attendance Commitments and No-Show Policy
This is important: If you RSVP, register, or otherwise indicate that you will attend, participate in, host, or vend at an event listed on the Platform, other Members and event organizers may rely on that commitment. A pattern of “no-shows” — confirming attendance and then failing to appear without reasonable notice or cause — undermines trust in the Platform for everyone.
Accordingly, Siouxland Made reserves the right, in its sole discretion, to:
- Suspend or permanently revoke a Member’s ability to create or post Event Listings, RSVP to events, or participate in the event calendar, if that Member no-shows to an event they committed to attend, host, or vend at;
- Issue a warning, require a cooling-off period, or place conditions on a Member’s continued use of event features before restoring full privileges;
- Remove any Event Listing at any time, for any reason, including listings that appear inaccurate, fraudulent, or unsafe; and
- Consider a Member’s no-show history in evaluating that Member’s standing on the Platform generally, including access to other features described in this Agreement.
This right applies regardless of whether the no-show caused measurable harm, and Siouxland Made is not obligated to investigate, mediate, or resolve disputes about why an event was missed before exercising it. Members who anticipate being unable to attend an event they committed to are expected to update their RSVP or notify the organizer as soon as reasonably possible.
3.3 No Responsibility for Events
Siouxland Made does not organize, staff, insure, or guarantee any event listed on the Platform. Attendance at, or reliance on, any Event Listing is at each Member’s own risk. Event organizers, not Siouxland Made, are responsible for the safety, execution, and any promises made regarding their events.
4. Directory Listings
Members may create listings describing their business, farm, craft, or maker profile, including contact information, product or service descriptions, and images. Members are solely responsible for the accuracy of their Directory Listing and for honoring any representations made in it. Siouxland Made does not verify licensing, insurance, business registration, or product claims, and does not guarantee the quality, safety, or legality of any goods or services described in a Directory Listing. We reserve the right to edit, decline to publish, or remove any Directory Listing at our discretion, including for inaccurate, misleading, or inappropriate content.
5. Job Board Listings
Members may post job openings or seek employment/gig opportunities through the Job Board. Employers are solely responsible for the accuracy and legality of their postings, including compliance with applicable employment laws, and for any hiring decisions or offers they make. Job seekers are solely responsible for the accuracy of information they provide. Siouxland Made is not the employer, is not a party to any employment or contractor relationship formed through the Job Board, and does not guarantee that any posted position is genuine, currently available, or will result in employment. We reserve the right to remove any Job Board Listing at our discretion, including postings that appear fraudulent, discriminatory, or otherwise inappropriate.
6. Community Forum
The Community Forum is a space for Members to share ideas, ask questions, and discuss topics relevant to the Siouxland maker community. Opinions and statements posted in the Forum belong solely to the Member who posted them and do not reflect the views of Siouxland Made. Members must treat one another respectfully. Siouxland Made may remove any Forum post or comment, and may suspend or restrict a Member’s forum access, at its discretion, including for content that is abusive, false, spam, off-topic, or otherwise violates this Agreement.
7. Member Conduct
By using the Platform, you agree that you will not:
- Post false, misleading, or fraudulent Event, Directory, or Job Board Listings;
- Repeatedly commit to attend events and fail to appear without reasonable notice;
- Harass, threaten, defame, or discriminate against other Members;
- Use the Platform to solicit for illegal goods, services, or activity;
- Impersonate another person or business, or misrepresent your affiliation with any organization;
- Scrape, resell, or misuse other Members’ contact information or Content collected through the Platform; or
- Interfere with the normal operation or security of the Platform.
8. Our Right to Moderate and Restrict Access
In addition to the specific rights described above, Siouxland Made reserves the right, at its sole discretion and without prior notice, to remove any Listing or Content, suspend or terminate any Member’s account or access to any feature (including Event, Directory, Job Board, or Forum features individually), and refuse service to any Member, for violation of this Agreement or for any other reason we deem appropriate to protect the integrity, safety, or trustworthiness of the Platform and its community.
9. Content Ownership and License
You retain ownership of the Content you post. By posting Content to the Platform, you grant Siouxland Made a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that Content in connection with operating and marketing the Platform (for example, featuring an event on our homepage or social media). You represent that you have the right to post the Content you submit.
10. Disclaimer of Warranties
THE PLATFORM AND ALL LISTINGS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. SIOUXLAND MADE DOES NOT WARRANT THAT ANY EVENT, DIRECTORY LISTING, JOB POSTING, OR FORUM STATEMENT IS ACCURATE, RELIABLE, OR WILL OCCUR OR BE FULFILLED AS DESCRIBED.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SIOUXLAND MADE AND ITS OWNERS, OPERATORS, AND STAFF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM, (B) ANY CONDUCT OR CONTENT OF ANY MEMBER, INCLUDING ANY NO-SHOW, MISREPRESENTATION, OR FAILURE TO HONOR A COMMITMENT MADE THROUGH AN EVENT, DIRECTORY, JOB BOARD, OR FORUM LISTING, OR (C) ANY TRANSACTION OR RELATIONSHIP BETWEEN MEMBERS, EVEN IF SIOUXLAND MADE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SIOUXLAND MADE’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THIS AGREEMENT WILL NOT EXCEED FIFTY DOLLARS ($50).
12. Indemnification
You agree to indemnify and hold harmless Siouxland Made and its owners, operators, and staff from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your Content, your Listings, your breach of this Agreement, or your dealings with other Members.
13. Termination
You may stop using the Platform and close your account at any time. Siouxland Made may suspend or terminate your account or access to any feature at any time, with or without cause or notice, as described in this Agreement. Sections 2, 9–12, and 14–16 survive termination.
14. Changes to This Agreement
We may update this Agreement from time to time. If we make material changes, we will post the updated Agreement on the Platform with a new “Last Updated” date. Continued use of the Platform after changes take effect constitutes acceptance of the updated Agreement.
15. Governing Law
This Agreement is governed by the laws of the State of Iowa, without regard to its conflict-of-laws principles, and any disputes will be resolved in the state or federal courts located in Iowa.

Vendor Agreement
This Vendor Agreement (“Agreement”) is entered into between Siouxland Made (“Platform,” “we,” “us”) and the business or individual listing or selling products or services through the Platform (“Vendor,” “you”). By listing products, services, or events on Siouxland Made, or by signing this Agreement, you agree to the terms below.
1. Independent Business Relationship
Vendor is an independent business, and nothing in this Agreement creates an employment, partnership, joint venture, or agency relationship between Vendor and Siouxland Made. Vendor is solely responsible for its own products, services, pricing, fulfillment, customer service, and compliance with applicable law.
2. Compliance with Law
Vendor represents and warrants that it holds, and will maintain throughout its relationship with the Platform, all licenses, permits, registrations, and certifications required to lawfully produce, prepare, label, and sell its products or services in the state(s) and locality where it operates and sells, including but not limited to:
- Applicable cottage food, home-based business, or food establishment laws (Iowa, Nebraska, and/or South Dakota, as applicable to Vendor’s location and sales area).
- FDA and/or state cosmetic and personal care product labeling requirements, where applicable.
- Any required allergen disclosure, ingredient labeling, or “made in a home kitchen not inspected by the state” disclosures required by Vendor’s home state.
- Any other local, state, or federal licensing requirements applicable to Vendor’s specific products or services.
Vendor agrees to provide proof of any such license, permit, or registration to Siouxland Made upon request.
3. Items Excluded from Sale
The following items are excluded from sale and marketing on our website:
- Adult material
- Cannabis, CBD oil, hemp, or any cannabis or CBD oil infused products
- Farming supplies, pesticides, herbicides, or fertilizers
- Individual items valued at $1,000 or more per item
- Guns, firearms, ammunition, weapons, or any weapon accessories
- Liquor or alcoholic products
- Tobacco products (including vaping products, e-cigarettes, hookahs)
- Protective equipment including but not limited to helmets and sports gear
- Pharmaceuticals, including contraceptives and “health and wellness” type products such as homeopathic, herbal remedies, nutraceuticals, vitamins, nutrition or diet supplements
- Child safety devices or equipment, furniture intended for infants or children, or children’s sleepwear
4. Product Labeling and Disclosure
For food, beverage, and beauty/personal care products, Vendor agrees to provide a complete and accurate list of ingredients for each product listed on the Platform, and to promptly update that information if a recipe or formulation changes. Vendor is solely responsible for the accuracy of all product descriptions, ingredient lists, and claims made about its products.
5. Insurance
Vendor agrees to maintain general liability insurance (and, for food or beauty/personal care products, product liability coverage) in an amount reasonably sufficient to cover claims arising from Vendor’s products or services, for as long as Vendor lists or sells through the Platform. Vendor agrees to provide proof of coverage to Siouxland Made upon request.
6. No Endorsement or Testing by Platform
Vendor acknowledges that Siouxland Made does not test, inspect, certify, or independently verify Vendor’s products, services, ingredients, or business practices, and that inclusion on the Platform is not an endorsement or guarantee of quality, safety, or compliance with any law.
7. Indemnification
Vendor agrees to indemnify, defend, and hold harmless Siouxland Made, its owners, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Vendor’s products, services, or events;
- Any injury, illness, allergic reaction, or property damage caused or allegedly caused by Vendor’s products or services;
- Vendor’s breach of this Agreement or violation of applicable law;
- Any claim that Vendor’s products, content, or listings infringe the rights of a third party.
8. Limitation of Platform Liability
To the fullest extent permitted by law, Siouxland Made’s liability to Vendor arising out of this Agreement or Vendor’s use of the Platform is limited to the fees, if any, paid by Vendor to Siouxland Made in the twelve (12) months preceding the claim. Siouxland Made is not liable for indirect, incidental, or consequential damages, including lost profits or lost sales.
9. Accurate Attribution
Vendor agrees that its listings will clearly identify Vendor as the maker or provider of the product, service, or event, so that customers understand they are purchasing from or engaging with Vendor directly, and not from Siouxland Made.
10. Removal of Listings
Siouxland Made reserves the right to remove, suspend, or decline any listing, product, or Vendor account at its discretion, including where Vendor cannot provide proof of required licensing, insurance, or accurate labeling upon request.
Siouxland Made also reserves the right to remove, suspend, or decline any listing, product, or Vendor account at its discretion when vendors have not fulfilled orders as stated.
11. Term and Termination
This Agreement remains in effect while Vendor lists or sells through the Platform and survives termination with respect to any claims, obligations, or transactions that arose during that time.
12. Governing Law
This Agreement is governed by the laws of the State of Iowa, without regard to its conflict-of-law principles, unless otherwise required by applicable law. [Confirm with counsel — may want to specify a particular county/venue for disputes.]
13. Entire Agreement
This Agreement, together with Siouxland Made’s Terms and Conditions, constitutes the entire agreement between Vendor and Siouxland Made regarding the subject matter herein and supersedes any prior understandings.
Siouxland Made Subscription Refund Policy

Thank you for choosing Siouxland Made, LLC (“we,” “us,” or “our”). This Refund Policy explains the terms under which refunds are issued for memberships purchased through our online marketplace platform siouxlandmade.com
1. 30-Day Refund Window
We offer refunds only for membership purchases requested within 30 calendar days of the original purchase date.
- The 30-day period begins on the date the membership is purchased, not the date it is first used or activated.
- Refund requests submitted after the 30-day window has closed will not be eligible for a refund, except where required by applicable law.
2. Eligibility Requirements
To qualify for a refund, the following conditions must be met:
- The refund request must be submitted within 30 days of the original purchase date.
- The membership must have been purchased directly through Siouxland Made’s Platform.
- The request must include the account email address and order/transaction ID associated with the purchase.
3. How to Request a Refund
To request a refund, please contact us using one of the following methods within the 30-day window:

Please include your name, business name, account email, phone number and reason for the refund request. We may follow up to confirm your identity and purchase details.
4. Processing Refunds
- Approved refunds will be processed within 7-10 business days of approval.
- Refunds will be issued to the original payment method used at checkout. We are unable to issue refunds to a different payment method or account.
- Depending on your bank or payment provider, it may take an additional 3–5 business days for the refunded amount to appear in your account.
5. Membership Access After Refund
Once a refund is approved and processed:
- Your membership benefits will be deactivated, typically effective immediately or at the end of the current billing period, as applicable.
- You may lose access to any features, listings, discounts, or services tied to your membership tier.
6. Non-Refundable Circumstances
Refunds will not be granted in the following situations:
- The request is made more than 30 days after the original purchase date.
- The membership was purchased as part of a promotional offer explicitly marked as non-refundable.
- The account has been found to violate our Terms of Service, including fraudulent activity or abuse of the refund policy.
- Renewal charges for memberships, unless the renewal itself falls within its own 30-day refund window from the renewal charge date.
7. Renewals and Recurring Memberships
If your membership automatically renews, each renewal charge is treated as a new purchase for refund purposes, and is eligible for a refund only if a request is submitted within 30 days of that specific renewal charge.
We recommend reviewing your renewal date and canceling in advance if you do not wish to be charged again. Cancellation prevents future charges but does not automatically issue a refund for a charge already processed.
8. Exceptions
We may, at our sole discretion, make exceptions to this policy on a case-by-case basis, including for extenuating circumstances or as required by consumer protection laws in your jurisdiction.
9. Chargebacks
We encourage customers to contact us directly before initiating a chargeback with their bank or card provider. Unauthorized chargebacks may result in suspension of your account while the matter is investigated.
10. Changes to This Policy
We reserve the right to modify this Refund Policy at any time. Changes will apply to purchases made after the updated policy’s effective date and will be posted on this page with a revised “Last Updated” date.

These Terms and Conditions (“Terms”) govern your access to and use of siouxlandmade.com and all related pages, tools, and services (collectively, the “Site“), which are owned and operated by [Siouxland Made legal entity name, e.g., Siouxland Made, LLC] (“Siouxland Made“, “we“, “us“, or “our“). By accessing or using the Site, creating an account, purchasing a Listing, Membership, or Vendor subscription, or otherwise using our services, you (“you” or the “User“) agree to be bound by these Terms. If you do not agree, do not use the Site.
These Terms apply to everyone who uses the Site, including visitors, consumers, business owners who create a Listing, Members, Vendors, event hosts, job posters, job seekers, and forum participants. Additional terms apply to specific roles and are incorporated into these Terms by reference, including the Vendor Agreement, the Member Agreement, the Customer Terms and Conditions, the Job Board Terms and Conditions, and the Privacy Policy. If there is a direct conflict between these Terms and a role-specific agreement, the role-specific agreement controls for that activity.
1. Who We Are
Siouxland Made is a website that helps people discover, connect with, and buy from independent local businesses in the Siouxland area. We operate a business directory, an online marketplace for locally made goods, an events calendar, a community forum, and a job board. Siouxland Made is a platform provider only. We are not a party to, and assume no responsibility for, transactions, agreements, or interactions between Users, including between buyers and sellers, employers and job seekers, or event hosts and attendees.
2. Eligibility
You must be at least 18 years old to create an account or enter into any subscription with Siouxland Made. Business Listings, Memberships, and Vendor accounts are limited to owners of local independent businesses headquartered in the Siouxland area, defined as a 70-mile radius from downtown Sioux City, Iowa. Majority ownership of the business must reside with an owner whose primary residence is within the Siouxland area. A business may operate multiple locations, provided it is headquartered within the Siouxland area. Franchises and multi-level marketing businesses headquartered outside the Siouxland area do not qualify. Requests for an exception to this boundary may be submitted through our Contact Us page for individual consideration.
If you are registering a business, you represent that you have the authority to bind that business to these Terms and to any applicable role-specific agreement.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information when registering and to keep that information up to date. You must notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account, but you may be liable for losses we or others incur as a result of such unauthorized use.
4. Listings, Memberships, and Vendor Subscriptions
Siouxland Made offers three subscription levels for local businesses: Listing Only, Member, and Vendor, each with different features and annual pricing as described on the Site and in the applicable agreement. We do not certify, verify, license, or accredit any business. Business owners self-certify that they meet the eligibility criteria described in these Terms, and Siouxland Made relies on that self-certification. See Section 12 (Site Disclaimer) below.
We do not currently accept payment to feature a business’s products, events, or listings outside of the standard subscription tiers, and we do not intend to offer paid promotional add-ons. Subscription pricing is intended to remain stable over time; if pricing does change, Users enrolled in auto-renewal will be notified by email at least 30 days before the change takes effect on their renewal.
Non-profit organizations may list for free, subscribe to Membership at 50% of the standard rate, and subscribe to the Vendor tier at the regular rate, subject to providing documentation of non-profit status upon request.
5. Marketplace, Pickups, and Payments
Vendors sell products directly to consumers through the Site’s marketplace. Siouxland Made does not charge sales commissions; payments for online marketplace purchases are processed through the Vendor’s chosen third-party payment processor (Stripe or PayPal), and funds are paid directly to the Vendor. Sales tax on purchases made through the Site’s marketplace, where applicable, is collected by Siouxland Made and remitted to the State of Iowa on the Vendor’s behalf, in accordance with Iowa law. Vendors are solely responsible for collecting and remitting sales tax on sales made outside the Site’s marketplace, including cash-at-pickup transactions.
Additional terms governing marketplace purchases, collective pickups, individual pickups, and order fulfillment are set out in the Vendor Agreement and the Customer Terms and Conditions, both of which are incorporated into these Terms.
6. Events, Promotions, and the Job Board
Members may post events, promotions, and job openings, and may access the reverse job board and volunteer/donation board, subject to the posting limits and requirements described in the Member Agreement and Job Board Terms and Conditions. If you are unable to fulfill a posted event, you must notify us immediately so the listing can be removed and, where appropriate, an announcement made. Repeated failure to honor posted events or job listings may result in removal of posting privileges.
7. Community Forum and User Conduct
Siouxland Made hosts an online forum for Members to ask questions, network, and discuss buying, selling, and trading. All forum activity and other content you submit to the Site must be lawful and family-friendly (PG-rated), regardless of the age restrictions, if any, applicable to your own products or services. You agree not to use the Site to:
- Post content that is unlawful, defamatory, harassing, obscene, or that infringes another person’s rights;
- Advertise, sell, or promote the sale of alcohol, firearms or ammunition, or any other legally controlled or age-restricted substance;
- Misrepresent your business, its ownership, location, or the products or services you offer, including false claims that a product is locally made, grown, designed, created, or significantly altered by you;
- Resell new or used products that you did not make, grow, design, create, or significantly alter, through the Vendor marketplace;
- Interfere with the operation of the Site or attempt to gain unauthorized access to any account or system; or
- Use the Site for any purpose that violates applicable local, state, or federal law.
We may investigate, remove content, suspend, or terminate accounts that violate these Terms, in our sole discretion, with or without notice.
8. Public Reviews
Listings, Members, and Vendors are subject to public consumer reviews as a core feature of the Site. Reviews reflect the opinions of the individuals who submit them and not the opinions of Siouxland Made. If you believe a review about your business is unfair, inaccurate, or violates these Terms, contact us and we will investigate. We are not obligated to remove a review solely because a business disagrees with it.
9. Intellectual Property
The Site, including its design, text, graphics, logos, and software (excluding User-submitted content and third-party business content), is owned by Siouxland Made or its licensors and is protected by intellectual property laws. You retain ownership of content you submit (such as business descriptions, photos, and product listings), but you grant Siouxland Made a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and distribute that content on the Site and in related marketing (including social media and weekly emails) for as long as your account remains active, and for a reasonable period afterward to remove archived references.
10. Third-Party Links and Services
The Site may link to, or integrate with, third-party websites and services, including payment processors, social media platforms, and individual businesses’ own websites. We do not control and are not responsible for the content, policies, or practices of any third-party site or service.
11. Disclaimers
The Site and all content, listings, and products offered through it are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Siouxland Made does not warrant that the Site will be uninterrupted, secure, or error-free.
12. Site Disclaimer (Businesses, Products, and Endorsement)
Siouxland Made is a directory and marketplace designed to help people discover and connect with local businesses, vendors, service providers, and events in the Siouxland area. We do not certify, endorse, license, or accredit any business, individual, product, or service listed on the Site, and inclusion in our directory or marketplace is not a recommendation or guarantee of quality, safety, legality, or reliability.
We do not independently verify, inspect, test, or evaluate any goods, products, or services offered by businesses listed on or selling through Siouxland Made. We make no representations or warranties regarding the accuracy, completeness, safety, quality, or fitness for a particular purpose of any listing, product, or service. Any claims made by a business — including but not limited to claims about ingredients, materials, licensing, insurance, certifications, or business practices — are the sole responsibility of that business.
All businesses and vendors are independently owned and operated. They are not employees, agents, partners, or representatives of Siouxland Made. Any transaction, agreement, or interaction you have with a listed business is solely between you and that business, and Siouxland Made is not a party to it and assumes no liability for it. We encourage you to do your own research, ask questions, and use your own judgment before purchasing products, hiring services, or engaging with any business found through the Site.
13. Limitation of Liability
To the fullest extent permitted by law, Siouxland Made and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site, any transaction with a business listed on the Site, or these Terms, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Site or these Terms will not exceed the greater of $100 or the amount you paid to Siouxland Made in the 12 months before the claim arose.
14. Indemnification
You agree to indemnify, defend, and hold harmless Siouxland Made and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your content, products, or services; (c) your violation of these Terms or any role-specific agreement; or (d) your violation of any law or the rights of a third party.
15. Termination
You may close your account at any time by contacting us. We may suspend or terminate your access to the Site, or any Listing, Membership, or Vendor account, at any time, with or without cause or notice, including for violation of these Terms. Sections of these Terms that by their nature should survive termination (including Sections 9, 11, 12, 13, 14, and 18) will survive.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Site and update the “Last Updated” date above. For changes that affect subscription pricing, Users enrolled in auto-renewal will receive at least 30 days’ advance notice by email, as described in Section 4. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in [Woodbury County / Sioux City], Iowa, and you consent to personal jurisdiction in those courts.
18. Miscellaneous
These Terms, together with the Privacy Policy and any applicable role-specific agreement, constitute the entire agreement between you and Siouxland Made regarding the Site. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.

Customer Terms & Conditions

These Customer Terms and Conditions (“Customer Terms”) apply to you when you browse, order, or purchase products through the Siouxland Made online marketplace (the “Marketplace”) at siouxlandmade.com (the “Site”). They supplement and are part of the Site’s general Terms and Conditions and Privacy Policy. By placing an order on the Marketplace, you agree to these Customer Terms.
1. Who You’re Buying From
Products on the Marketplace are sold by independent local Vendors, not by Siouxland Made. Siouxland Made operates the platform, provides the checkout and pickup/shipping coordination tools, and — for purchases completed through Marketplace checkout — collects and remits applicable Iowa sales tax. Siouxland Made is not the seller of record for any product, does not manufacture, inspect, or guarantee any product, and is not a party to the sale contract between you and the Vendor.
2. No Endorsement or Certification
Siouxland Made does not certify that a Vendor is an independent local business or that its products are actually made, grown, designed, created, or significantly altered by that Vendor, and does not endorse any Vendor or product. We rely on Vendors’ own representations. Please see the Site Disclaimer in the Terms and Conditions for additional detail, and use your own judgment when deciding what to purchase and from whom.
3. Product Availability and Restrictions
The Marketplace does not offer alcohol, firearms, or other legally controlled substances for sale. All products listed and sold through the Marketplace are intended to be family-friendly and lawful to advertise and sell to the general public, since the Site itself is not age-restricted. Vendors may link to their own separate websites for age-restricted or otherwise legally restricted products, but such products cannot be purchased through the Site.
4. Pricing, Payment, and Sales Tax
Prices are set by individual Vendors. Payments for Marketplace orders are processed through Stripe or PayPal, according to the Vendor’s chosen processor and that processor’s own terms. Where applicable, Iowa sales tax is calculated and collected at checkout and remitted by Siouxland Made to the State of Iowa on the Vendor’s behalf. If a Vendor allows cash payment at an individual pickup instead of online prepayment, sales tax responsibility for that transaction rests with the Vendor, not with you, though you should expect to pay applicable tax at the time of that transaction.
5. Collective Pickups
A collective pickup lets you shop multiple Vendors in a single transaction for pickup at a shared, recurring time and location. Vendors are responsible for their products up until the end of the scheduled pickup window. Once the pickup window ends, responsibility for any products you have not yet collected shifts to you as the buyer — Siouxland Made and the pickup organizer are not responsible for products left unclaimed after the window closes. If a Vendor sells under Iowa’s cottage food law or a similar exemption, that Vendor is required to be present to hand your order to you directly.
6. Individual Pickups and Shipping
For individually scheduled pickups, the Vendor sets the available times and locations, which you select at checkout or as instructed by the Vendor. Some Vendors may allow cash payment at pickup instead of prepayment online. If a Vendor offers shipping, delivery timing and method are set by that Vendor.
7. Order Problems, Refunds, and Cancellations
If a Vendor is unable to fulfill your order or cannot make a scheduled pickup, the Vendor is required to notify you as soon as possible and issue a full refund for that order. If you are not satisfied with a product you received, please contact the Vendor directly first — customer service issues are handled by the Vendor, not by Siouxland Made. You may also ask for help identifying next steps through the Site’s community forums.
If you and a Vendor cannot resolve a dispute directly, you may contact Siouxland Made to escalate the matter. A staff member will look into escalated disputes and may recommend arbitration or another resolution process, but Siouxland Made is not obligated to resolve the dispute, does not guarantee a particular outcome, and is not a party to the underlying sale.
8. Reviews
After a purchase, you may be invited to leave a public review of the Vendor or product. Reviews should be honest and based on your own experience. Reviews you submit may be publicly displayed on the Site, together with your name or username as configured on the Site, consistent with the Privacy Policy.
9. Disclaimers and Limitation of Liability
Products sold through the Marketplace are provided by independent Vendors “as is,” and Siouxland Made makes no warranties of any kind regarding those products, including as to their safety, quality, legality, or fitness for a particular purpose.
The disclaimers, limitation of liability, and indemnification provisions of the Site Terms and Conditions apply fully to your use of the Marketplace. Your legal recourse for a defective, unsafe, misrepresented, or undelivered product is against the Vendor, not Siouxland Made, except to the extent a loss is directly caused by Siouxland Made’s own gross negligence or willful misconduct in operating the checkout or tax-remittance function.
10. Changes to These Customer Terms
We may update these Customer Terms from time to time consistent with the process described in the Site Terms and Conditions. Continued use of the Marketplace after changes take effect constitutes acceptance of the updated Customer Terms.
